Pasadena Texas, Mystery Crash

Police are investigating a crash which claimed the lives of two women on Red Bluff at Genoa in Pasadena, Texas. Recently, two women were traveling north in a pickup truck on Red Bluff when they, for an unknown reason, lost control and skidded off the road to the right. The truck went into a field, crashed through a barbed wire fence and rolled over several times. One woman dies at the scene and the other was rushed to the hospital, where she later died.

The police are trying to figure out why the women skidded to the right. They are investigating to see if they were possibly cut off by another vehicle. If that was shown to be the case, an uninsured motorist claim could be made. The argument would be that a phantom vehicle caused the collision.

Drinking and Driving. Another Senseless Tragedy

Cy-Fair Fire Captain Mark Rodriguez is no stranger to drunk-driving accidents. In February of this year, however, he found his own daughter dead at the scene of a crash on Highway 6. Later that same week, about 200 people gathered to erect a cross memorial at the scene of the crash where 22-year-old Krysta Rodriguez was killed.

Krysta Rodriguez was riding in a passenger seat of her boyfriend's car when they were T-boned by a pickup truck as they turned into a Whataburger parking lot. Investigators believe that the driver of the pickup was intoxicated. Witnesses indicated that he was headed northbound, at a high rate of speed, with his headlights off, when he crashed into the car carrying Rodriguez. The pickup truck driver admitted that he had been drinking and failed a field sobriety test. He has been charged with intoxication manslaughter.

Is It Really As Cool As It Looks?

Don't you wonder if those motorcycle guys who zoom pass you crash? It looks so dangerous but cool at the same time. A recent accident shows what often happens to these guys.

Recently, a motorcycle rider was killed in a crash on the South Loop in the westbound lanes near Stella Link. The motorcyclist was traveling at a high rate of speed, weaving in and out of lanes, when he smashed into the back end of a Honda Civic. He was not wearing a helmet and died at the scene. Apparently, it is not as cools as it looks.

How Unfair?

Investigators claim an allegedly intoxicated driver caused the death of a passenger after the vehicle flipped over a bayou in Northwest Houston. The vehicle hit a curb and flipped over on North Victory Drive new Danjo Street. The female passenger was thrown from the vehicle and died. The driver survived.

The deceased passenger's family may not even have a claim against the driver. If it is shown that the passenger got into the vehicle knowing the driver was intoxicated, a defense that could be raised will be that under these circumstances the passenger "assumed the risk" of injury. If successful, "assumption of the risk" is a complete defense. Do not get into the car if the driver is intoxicated, if so, you really do assume a terrible risk.

Recently, there were some scary moments for children on a Galena Park ISD bus. A 18-wheeler crashed into the back of a bus on the Gulf Freeway near the South Loop interchange. All Five children on the bus were taken to the Ben Taub Hospital.

The truck driver appears to be the at fault party. However, if injuries occur, they may also be sustained because of safety issues. Children on buses, unlike in cars, are often not wearing safety belts. Seat backs in buses often do not meet the strength requirements.

Police have been investigating a car accident that occurred in Houston after a man crashed his car into a Hilton parking garage at Avenue De Las Americas and Polk. The driver was driving a Nissan south on Avenue De Las Americas when his passengers told him he had turned the wrong way. He became confused, slammed his brakes, and proceeded to slide on the wet road over the curb and into a glass stairwell entry on the parking garage. The vehicle came to a rest in the stairwell. Speed was a factor in this accident.

Liability should not be an issue for anyone injured as a result of this drivers actions. The damage case can certainly be helped, however, by the Hilton surveillance tapes which captured the entire incident. Drinking and Driving = Injuries or Tragedy

One March 2, 2010, in Houston, Texas one person was fighting for his life and one was arrested, after a single car crash on Beechnut in the early morning. Police investigators said a man was driving westbound on Beechnut with another man and a woman in his car when he hit a curb and lost control. The car spun around and smashed into a pole. The male passenger in the backseat was not wearing a seatbelt and sustained a massive head trauma. The driver was arrested on the suspicion of "driving while intoxicated."

The accident presents numerous recurring issues. First, backseat passengers must wear seat belts. Many do not believe that the seat belt law applies to backseat passengers. They are wrong. Countless more lives will be saved each year if backseat passengers wear seat belts.

Second, do not get into a car if the driver has been drinking. If you do, and the driver causes an accident, you may be barred from obtaining any personal injury recovery. Third, the driver himself, may be liable for punitive, punishment, and damages for causing the accident.

Beware of the Drunken Cop

An internal investigation has determined that a Forth Worth, Texas police officer was drinking on duty before crashing a city vehicle and killing a mother of two. A review found that officer, Jesus Cisneros drove to three bars and drank up to three beers in an unauthorized undercover detail before going off duty, drinking more, and colliding with a car driven by Sonia Baker. He has been charged with intoxication, manslaughter, and has resigned from the police force.

In the civil suit the issues will focus on the liability of the police department, the officer's employer, and the limit of their insurance coverage, Unfortunately, must municipalities can only be used up to a certain limited dollar amount.

Multiple Car Accident. Who is to Blame?

Two weeks ago, the westbound lanes of the South Loop were closed near Scott after an accident involving a tanker truck. Three people were taken to area hospitals with injuries. Police say the chain-reaction happened when a silver Mercedes struck a green Mitsubshi Galant.

The issue is these accidents is always which vehicle, or vehicles, were driving too close. Obviously, the last car in the line is at fault. The question, however, for the other vehicles is did they strike the car in front of them before, or after, they were hit from behind. The answer will determine whether they have a claim.

Hit and Run Tragedy

Both Robyn Romano and her mother were struck in a November by a hit and run driver. Robyn's mother was killed. The facts are horrific. George Theoblad allegedly was driving a stolen truck when he hit Romano's SUV. As the two women got out, Theoblad allegedly backed into Robyn Romano pinned her against her vehicle and then hit her mother as she tried to free her daughter. He then supposedly drove off, leaving Brenda to die.

Brenda happened to be in Houston visiting for Robyn's father's birthday. She saved her daughters life, and in doing so, she was killed. No insurance coverage can adequately compensate anyone in this situation. In fact, the only coverage available will be the Romano's uninsured motorist coverage since Theobald was driving a stolen vehicle.
